A corporate owner in southern Texas admitted on April 30 so as not to pay a tax on employment in his local business, said American lawyer Nicholas J. Ganjei.
Timothy Gaines Pollard, from McCoy, Texas, owned and operated Tim Pollard Construction, a residential renovation and closing installation company in Bishop and Kingsville, according to an indictment filed with the American district court of the South Texas District on March 27, 2024.
Pollard pleaded guilty of not having retained, retained or paying taxes on the employment of payroll checks from 2018 to 2022, including federal income, social security and health insurance.
A stipulation of the facts filed with the court declared that he had retained money from his employees during this period but that he had not paid in the United States, as required, and rather spent the funds on personal expenses.
More specifically, during the 2019 fourth quarter, he did not pay the IRS wage bill more than $ 36,700 in taxes he had received from employees.
An IRS agent spoke with Pollard in November 2018 and put it in the opinion of obligation to pay the taxes on pay, according to court documents.
During this conversation, Pollard acknowledged that he was responsible for paying taxes at IRS and agreed to stay up to date with his payments.
Although the company has retained the appropriate amount of taxes on the payroll checks for employees from 2018 to 2021, it failed to fully pay taxes on the IRS, which were to have every quarter during this period.
From January 2019, Pollard made no other quarterly payment of payroll taxes at IRS and did not produce income tax declarations with IRS, documents said.
In total, Pollard failed to represent more than $ 421,000 in total taxes, according to the judicial archives.
US district judge David S. Morales will impose a conviction on July 30.
Pollard risks up to five years in prison, a maximum fine of $ 250,000 or both penalties, and could receive up to three years of supervised release after imprisonment.
He was authorized to stay on bond while waiting for this hearing.
